1. Acceptance
By accessing or using Kadima's account and authentication experience, you agree to these Terms & Conditions. If you do not agree, do not use the Kadima account surface.
These terms apply to the Kadima-branded identity layer. Separate Kadima services or products may impose additional product-specific terms, policies, or billing terms.
2. Eligibility and Accounts
- You must be at least 13 years old, or the minimum age required in your jurisdiction, to create or use a Kadima account.
- You must provide accurate account information and keep it up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for activity occurring under your account.
- You must notify us promptly if you suspect unauthorized access or a security incident involving your account.
3. Permitted Use
You may use Kadima's account infrastructure only for legitimate access, identity, and support purposes connected to Kadima services.
You may not:
- Use another person's account without authorization.
- Attempt to bypass authentication, access controls, rate limits, or account restrictions.
- Probe, disrupt, reverse engineer, or interfere with the security or operation of the Kadima account systems.
- Use the account surface for unlawful activity, fraud, harassment, impersonation, or rights infringement.
4. Subscription and Billing Identity
Where Kadima manages shared subscription identity or billing status, you authorize us and our payment providers to process the account and billing data necessary to activate, maintain, or change your subscription.
Prices, renewals, cancellations, and refund eligibility for a specific service may be governed by that service's own commercial terms in addition to these Terms & Conditions.
5. Communications
You agree that we may send transactional communications necessary to operate your account, including verification emails, password reset emails, account security notices, billing notices, and important legal or service announcements.
6. Suspension and Termination
We may suspend, restrict, or terminate access to the Kadima account experience if we reasonably believe you have violated these Terms, created security risk, engaged in fraudulent activity, or where we are required to do so by law.
We may also suspend access temporarily to protect the integrity, availability, or security of the system.
7. Intellectual Property
The Kadima website, account flows, branding, software, and related materials are owned by Kadima Technology or its licensors and are protected by intellectual property laws.
These Terms & Conditions do not grant you any ownership rights in the Kadima brand, website, or underlying identity systems.
8. Privacy
Our handling of personal data in the Kadima account experience is described in our Privacy Policy, which is incorporated by reference into these Terms & Conditions.
9. Disclaimers
The Kadima account experience is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
10. Limitation of Liability
To the fullest extent permitted by law, Kadima Technology will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Kadima account experience.
To the fullest extent permitted by law, our aggregate liability for claims relating to these Terms & Conditions will not exceed the amount you paid to Kadima for the relevant Kadima-managed account service in the twelve months preceding the event giving rise to the claim, or EUR 100 if no such amount was paid.
11. Governing Law
These Terms & Conditions are governed by the laws of the Netherlands, excluding conflict-of-laws rules. Unless mandatory law requires otherwise, disputes will be submitted to the competent courts in the Netherlands.
12. Changes and Contact
We may update these Terms & Conditions from time to time. If changes are material, we may provide notice through the Kadima account experience or by email. Continued use after the updated terms become effective constitutes acceptance of the revised terms.
